The In The Trenches Productions Website is the first entertainment website for women over 40 but we also know that we are not the only filmmakers out there making wonderful films that star women over 40. We want to support your efforts by giving you the opportunity to exhibit your film on our entertainment website. If you have a film that you think would resonate with our audience please follow the instructions and information provided below carefully.

CRITERIA:

Must star a woman over 40 or focus on an important woman's issue.
Must be no more than 1000 MB.
Can be any genre.
Please take time to browse the entire site so you are familiar with our mission and our goals.

OTHER PERTINENT INFO:

No fee is required and we pay no fees to show your film(s).
We will not be able to return your Submission Copy and other materials.
Only submit film(s) that have all necessary clearances and licenses and in which all content contained in the material is cleared.
Only submit film(s)) owned by you.
Do NOT submit a film that is obscene, pornographic, defamatory, or otherwise illegal.
Make sure you follow the instructions for the accepted format of your film if you choose to mail it instead of uploading.
In the Trenches Productions reserves the right to remove any film from the In the Trenches Productions Website that does meet the standards, mission, criteria and/or terms and conditions set forth by In the Trenches Productions and the In the Trenches Productions Submission Terms and Conditions Agreement.

SUBMISSION TERMS AND CONDITIONS AGREEMENT

Before submitting your ORIGINAL MATERIAL described below as the "MATERIAL" to IN THE TRENCHES PRODUCTIONS described below as "ITTP" (located at 2920 Nebraska Ave. Santa Monica, 90404) please read the following Agreement in its entirety. If you accept and agree with all of the provisions of this Agreement, you agree by clicking the UPLOAD button. If you are submitting your MATERIALS via mail, please print out, sign and date this Agreement and return it to ITTP (to the address above) with a copy of your MATERIAL for submission.

You agree that you have retained a copy of the MATERIAL for yourself and release ITTP from any and all liability for loss or other damage to the copies of all material submitted hereunder and understand that ITTP is under no obligation to return any submitted materials.

You agree that shall provide ITTP with current contact information throughout the use of the MATERIAL via email or through regular mail.

If you do not accept and agree with any provision or paragraph of the Agreement, please do NOT submit your MATERIAL to ITTP, because any submission of your MATERIAL to ITTP constitutes your full and complete acceptance of this Agreement. You agree to keep all records relating to your submission of MATERIAL and keep a copy of this Agreement for your records.

ITTP reserves the right, at its sole discretion, to deliver notices and disclosures to you by electronic and other means such as postal mail. Additionally, by submitting your MATERIAL to ITTP, you also agree to follow all the provisions set forth by ITTP in the Submission Terms and Conditions Agreement.

You further agree as follows:

- That ITTP, its successors and assigns, may use your MATERIAL on the ITTP website.

- That you will not receive any compensation for submitting, uploading and exhibiting your MATERIAL on the ITTP website.

- That ITTP may advertise, promote and publicize the MATERIAL in relation with the public via ITTP website.

- ITTP may use your Material without liability of any kind until you notify ITTP in writing to discontinue use of your Material 14 Days prior to requested removal date of the MATERIAL from the ITTP website.  Upon receiving the written termination request ITTP will remove the MATERIAL from the ITTP website within 14 days.

- That you are submitting the Material voluntarily and not in confidence or in trust, and that your submission of the Material does not create any confidential or fiduciary relationship between you and ITTP.  Any part of the MATERIAL, which any member of the public could freely use, may be used by ITTP without liability to you or any other entity claiming rights from or through you.

- That you secured all necessary clearances and licenses and all content contained in the MATERIAL is clear for the intended uses hereunder.  (A 'cleared' Film is a film that can be distributed, performed, copied, and otherwise exploited by Filmmaker (or its licensees/distributors) without infringing or violating, and without the likelihood of a claim of infringing or violating, some person or some entity's rights.)

- That you shall or have already made any and all necessary payments pursuant to any talent, guild, union, story, copyright, clip, music licenses, residual and any other payment obligations for the MATERIAL.

- That you believe the MATERIAL and its features are unique and novel. You acknowledge, however, that because of ITTP and its affiliates' positions in the entertainment industry, other persons, including ITTP'S employees, may have submitted to ITTP or to others, or may have made public, or may hereafter create, submit to ITTP or make public, similar or identical material that ITTP may have the right to use. You understand and agree that ITTP'S use of material similar to or identical with the MATERIAL you have submitted or containing features or elements similar to or identical with those contained in the MATERIAL will not obligate ITTP to negotiate with you, nor will it entitle you to any compensation of any kind if ITTP determines that it has an independent legal right to use such other material (for example and without limitation, because such features or elements were not new or novel, or were not originated by you, or were or may hereafter be independently created by or submitted to ITTP).

- That you represent that you are 18 years of age or older. If you are younger than the legal age to enter into contracts in your state, ITTP requires written consent from your parent or legal guardian.

- That you represent that your submission of the MATERIALl to ITTP will not violate or infringe any copyright, patent, privacy right, publicity right, trademark, service mark or any other personal or property right of any person or entity and that your MATERIAL does not constitute a defamation of any person or entity. You also represent that you are the sole owner of the MATERIAL and all rights therein, that it is original to you, and that you have the full right to submit the MATERIAL to ITTP upon all the terms and conditions contained herein. If your MATERIAL uses or is based on any third party material, you represent that you have paid and will pay in full all license fees, clearance fees, and other obligations, of any kind, arising from any use or commercial exploitation of the MATERIAL. You represent that the MATERIAL you are submitting is not obscene, pornographic, defamatory, or otherwise illegal. You represent that the MATERIAL contains no virus or other malicious code or material that will, upon the occurrence of an event, the passage of time, or otherwise, delete or alter any data or impair the operation of any computer system or any equipment or software thereon, or permit any unauthorized access to any such system, equipment or software.

- You agree to indemnify and hold ITTP, its affiliates, parent entities, and assignees harmless from and against any and all claims, losses, or liabilities (including reasonable attorneys' fees) that may be asserted against ITTP or incurred by any of the foregoing entities at any time in connection with the MATERIAL or any use thereof, and/or arising from any breach or alleged breach of any representation made by you to ITTP.

- That ITTP has sole discretion to remove MATERIAL from it's website at any time, without written or verbal prior notice and without explanation of any kind if the MATERIAL does not meet the standards, criteria, and/ or mission set by ITTP and does not adhere to the adhere to the regulations and requirements set forth by ITTP and the provisions set forth by this agreement.

- That you agree that any controversy arising out of or in connection with any alleged wrongful use of the MATERIAL, or a dispute with reference to this Agreement, its validity, or effect will be governed by the laws of the state of California. The courts of competent jurisdiction located in the City of Los Angeles will conclusively determine any controversy arising out of or in connection with any alleged wrongful use of the Material or a dispute regarding this Agreement, or its validity or effect.

- You agree that you have read and understand this Agreement, and you acknowledge that no oral representations of any kind have been made by ITTP and that this Agreement states the entire understanding between you and ITTP. Any modification or waiver hereunder must be in writing, affirmed by the party to be bound. The invalidity of any provision hereof will not affect the remaining provisions.
